NESHEP Main Meeting (2nd Feb) - Corporate Manslaughter Print E-mail

With the first Corporate Manslaughter case due in the courts in the very near future, this month’s presentation could not be more timely. Corporate manslaughter is increasingly becoming an extremely important subject, and hence it should be of interest to all concerned in the Group. We are therefore very fortunate to welcome Tim Hill who is a partner in the Health and safety group at Eversheds Tim specialises in the defence of criminal regulatory matters, including fatalities and corporate manslaughter, health and safety issues, environmental law, licensing, trading standards and road traffic cases. His recent experience includes: acting for a local authority following a fatal accident involving a piece of inflatable artwork in which two members of the public were tragically killed; acting for an international chemical company following a significant explosion at their plant; representing a national construction company in a Coroner's Inquest and subsequent HSE investigation; acting for a pharmaceutical company following a fatal incident at their manufacturing plant; acting for an NHS Trust after a patient in the community killed a charity worker; acting for a national energy company after an offshore helicopter crash involving seven fatalities. On this occasion he has offered to deliver a presentation entitled - The practical Impact of Corporate Manslaughter Investigations.

The content will include:

· Directors individual Duties and Liabilities

· Important updates on sentencing for individual Health and Safety offences

· Overview of the Corporate Manslaughter and Corporate Homicide act 2007

· Two Years on: How is the act being used in practice?

· Proposed Changes to sentencing

· The realities of a police led Corporate Manslaughter Investigation

Tim has extensive experience of all areas of regulatory law and criminal procedure in the Magistrates’ and Crown Courts, as well as crisis management, regulatory compliance, investigation and enforcement. He is also a Solicitor Advocate with rights of audience in the Higher Criminal Courts.
